Agreement to Terms

By downloading, installing, accessing, or using PixoAI (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

PixoAI is a mobile application that uses artificial intelligence to generate and edit images based on user-provided prompts and uploaded images. The App offers various features including:

  • AI-powered image generation from text prompts and source images
  • Interior design: Redesign and visualize room decoration
  • Fashion Model: Virtual try-on of clothing on AI-generated or user-provided model images
  • Product Mockups: Generate professional product photography and scene mockups
  • Professional Portrait: AI-generated corporate headshots and professional portraits
  • Image editing and enhancement

Eligibility

You must be at least 13 years old to use the App. If you are under 18, you represent that you have your parent's or guardian's permission to use the App and that they have agreed to these Terms on your behalf.

Subscription Services

Pro and Premium Subscriptions

  • The App offers Pro and Premium subscriptions with weekly, monthly, and yearly billing options
  • Subscriptions are purchased through Apple's In-App Purchase system
  • Subscription fees are charged to your Apple ID account
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
  • You can manage and cancel subscriptions through your Apple ID account settings
  • Pro provides access to all AI features with a set number of generations per billing period. Premium offers higher generation limits and priority support.

Subscription Terms

  • Billing: Subscriptions are billed in advance on a recurring basis
  • Renewal: Subscriptions automatically renew unless you cancel
  • Cancellation: You may cancel your subscription at any time through Apple's subscription management
  • Refunds: Refund requests must be submitted through Apple's refund process
  • Price Changes: We reserve the right to change subscription prices with 30 days' notice

Free vs. Paid Features

  • Subscribed users (Pro or Premium) have access to all features subject to generation limits per billing period
  • Free users have limited or no access to AI generation features
  • We reserve the right to modify which features require a subscription and the generation limits for each tier

User Content and Conduct

Your Content

  • You retain ownership of images you upload to the App
  • You grant us a license to use your uploaded images solely for the purpose of generating AI images
  • You are responsible for ensuring you have the right to use any images you upload

Prohibited Uses

You agree not to:

  • Use the App for any illegal purpose or in violation of any laws
  • Upload content that is offensive, harmful, defamatory, or violates others' rights
  • Attempt to reverse engineer, decompile, or extract the App's source code
  • Use the App to generate content that infringes on intellectual property rights
  • Upload images containing personal information of others without consent
  • Use the App to create deepfakes or misleading content intended to deceive

AI-Generated Content

  • Images generated by the App are created using artificial intelligence
  • AI-generated content may not be accurate, appropriate, or suitable for all purposes
  • You are solely responsible for how you use AI-generated content
  • We do not guarantee the quality, accuracy, or suitability of AI-generated images
  • AI-generated content may not be used for illegal, harmful, or deceptive purposes

Intellectual Property

Our Rights

  • The App, including its design, features, and functionality, is owned by us or our licensors
  • All trademarks, logos, and service marks are our property or the property of their respective owners

Your Rights

  • You own the images you generate using the App
  • However, your use of AI-generated content is subject to:
    • These Terms
    • The terms of service of third-party AI providers (such as NanoBananaPro and OpenAI)
    • Applicable copyright and intellectual property laws

Third-Party Services

The App uses third-party services:

  • AI Providers: Third-party AI services (including NanoBananaPro and OpenAI) provide AI image generation and editing capabilities
  • Apple: In-App Purchase processing and App Store distribution
  • Backend Services: Our backend API hosted on Vercel

Your use of these services is subject to their respective terms of service and privacy policies.

Disclaimers and Limitations of Liability

Service Availability

  • We do not guarantee that the App will be available at all times
  • The App may be unavailable due to maintenance, updates, or technical issues
  • We reserve the right to modify or discontinue the App at any time

AI Service Limitations

  • AI-generated content may contain errors, inaccuracies, or inappropriate content
  • We do not guarantee the accuracy, quality, or suitability of AI-generated images
  • AI services are provided by third parties and subject to their availability and limitations

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE PROVIDE THE APP "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND
  • WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your use of AI-generated content

Termination

By You

  • You may stop using the App at any time
  • You may cancel your subscription through Apple's subscription management
  • Uninstalling the App will remove locally stored data

By Us

We may terminate or suspend your access to the App immediately, without prior notice, if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Use the App in a manner that harms us or other users

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting updated Terms in the App
  • Updating the "Last Updated" date
  • Providing notice through the App when possible

Your continued use of the App after changes constitutes acceptance of the modified Terms.

Governing Law and Dispute Resolution

Governing Law

These Terms are governed by the laws of California, United States, without regard to conflict of law principles.

Dispute Resolution

  • Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association
  • You agree to resolve disputes individually and not as part of a class action

Apple-Specific Terms

If you downloaded the App from the Apple App Store:

  • These Terms are between you and us, not Apple
  • Apple is not responsible for the App or its content
  • Apple has no obligation to provide support or maintenance
  • If the App fails to conform to any applicable warranty, you may notify Apple for a refund
  • Apple is a third-party beneficiary of these Terms

Subscription Cancellation and Refunds

Cancellation

  • You may cancel your subscription at any time through your Apple ID account settings
  • Cancellation takes effect at the end of the current billing period
  • You will continue to have access to Pro features until the end of the billing period

Refunds

  • Refund requests must be submitted through Apple's refund process
  • We do not process refunds directly
  • Apple's refund policy applies to all subscription purchases

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

These Terms of Service are effective as of the date listed above. By using PixoAI, you acknowledge that you have read, understood, and agree to be bound by these Terms.
